Please read these Terms of Service (“Terms”) carefully before purchasing, accessing, or using any programs, services, content, or materials offered by Microbiome Method Coaching LLC (“Company,” “we,” “us,” or “our”).

By purchasing, enrolling in, accessing, or using any of our services, programs, or content (collectively, the “Services”), you agree to be legally bound by these Terms. If you do not agree, do not purchase or use our Services.

2. Eligibility

Our Services are intended solely for individuals 18 years of age or older. By using our Services, you represent and warrant that you are at least 18 years old.

3. Nature of Services (Important – Please Read Carefully)

Microbiome Method Coaching provides educational and health coaching services only.

We do not provide:

  • Medical care
  • Medical nutrition therapy
  • Diagnosis or treatment of disease
  • Mental health therapy
  • Emergency or urgent care

Participation in our Services does not create a physician–patient, clinician–patient, dietitian–patient, or therapist–client relationship.

All information provided is for educational and general coaching purposes only and is not a substitute for individualized advice from a licensed healthcare professional. You are responsible for consulting your own qualified professionals regarding medical, nutritional, mental health, or other healthcare decisions.

4. Personal Responsibility & Assumption of Risk

You understand and agree that:

  • You are voluntarily participating in coaching and educational activities
  • You are solely responsible for your decisions, actions, and results
  • Results are not guaranteed
  • Any changes you make to diet, lifestyle, supplements, or routines are made at your own discretion and risk

To the fullest extent permitted by law, you assume all risks associated with participation.

5. Use of Practice Better Platform

Our Services may be delivered through Practice Better or other third-party platforms. Your use of those platforms is subject to their respective terms and privacy policies. We are not responsible for platform outages, technical failures, or third-party system errors.

6. Intellectual Property

All content provided through our Services — including but not limited to videos, written materials, worksheets, graphics, program structure, recordings, and educational frameworks — is the exclusive property of Microbiome Method Coaching LLC or its licensors and is protected by intellectual property laws.

Limited License

You are granted a non-transferable, revocable, limited license to access and use the content for personal, non-commercial use only.

You may not:

  • Share, copy, distribute, sell, sublicense, or reproduce content
  • Use content for business, teaching, or commercial purposes
  • Create derivative works
  • Allow others to access your account or materials

Violation of these terms may result in immediate termination of access without refund.

7. User Contributions & Community Conduct

If you submit comments, messages, or other content through our platforms or communities:

  • You represent that you own the content and have the right to share it
  • You grant us a non-exclusive, royalty-free license to use, display, and reproduce it for program-related purposes

We reserve the right to remove content or terminate access for conduct that is disruptive, disrespectful, abusive, misleading, or otherwise inappropriate.

8. Privacy

Your use of our Services is subject to our Privacy Policy, which explains how we collect, store, and use personal information. We do not maintain medical records and do not collect protected health information (PHI) as defined under HIPAA.

9. Payments, Subscriptions & Billing

You agree to provide accurate billing information and authorize charges for purchased Services.

For subscriptions:

  • You may cancel future billing in accordance with platform instructions
  • Cancellation stops future charges only
  • No refunds are issued for prior billing periods

Failure to make timely payments may result in suspension or termination of access.

10. Refund Policy (Read Carefully)

All sales are final. We do not offer refunds once access to any program, service, or content has been granted.

We reserve the sole and exclusive right, at our discretion, to issue a refund or credit in exceptional circumstances. This discretion does not create an entitlement or expectation of a refund.

Chargebacks or payment disputes may result in immediate termination of access and may be pursued to the fullest extent permitted by law.

11. Disclaimer of Warranties

Our Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding outcomes, accuracy, completeness, or fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, Microbiome Method Coaching LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the Services.

Our total liability shall not exceed the amount paid by you for the Services in question.

13. Indemnification

You agree to indemnify and hold harmless Microbiome Method Coaching LLC and its owners, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of the Services or violation of these Terms.

14. Termination

We reserve the right to terminate or suspend access to our Services at any time, with or without notice, for violation of these Terms or for any reason deemed appropriate in our sole discretion.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

Any dispute shall be resolved through binding arbitration conducted in South Carolina, unless otherwise required by law. Each party shall bear its own legal costs unless otherwise awarded by the arbitrator.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
